These Terms of Service (“Terms”) are an agreement between you and Porchswing Technology & Senior Services, LLC (“Porchswing,” “we,” “us”), based in Rocklin, California. They cover your use of our website, our in-home and remote technology services, and the PorchswingProtect app and subscription (together, the “Services”). By using the Services — including by installing or activating PorchswingProtect — you agree to these Terms. If you don’t agree, please don’t use the Services.

Plain-English summary

PorchswingProtect is real antivirus plus a real human technician keeping an eye out. It adds strong protection, but no security product can stop every threat, and it doesn’t replace careful habits. You pay a subscription that renews automatically until you cancel, and you can cancel any time. The full terms are below — written as plainly as we can.

Who can use the Services

You must be at least 18 years old and able to enter into a contract. The Services are offered in the United States. You may set up and manage PorchswingProtect on behalf of a family member (for example, an adult child setting it up for a parent) — if you do, you’re responsible for having their permission and for the account.

What PorchswingProtect is — and what it is not

PorchswingProtect scans your computer for malware (using ClamAV and our own detection rules), checks websites against known-scam lists, watches for remote-access tools that scammers use, and lets a Porchswing technician monitor your device’s status and reach out to help.

It is a monitoring and protection aid, not a guarantee. We do not promise that the Services will detect or prevent every virus, scam, intrusion, data loss, or other harm. Threats change constantly, no scanner catches everything, and protection depends on things outside our control (your internet, your device, third-party software, and your own choices). PorchswingProtect is not a substitute for safe habits, for backing up your data, or for your own judgment. It does not provide legal, financial, tax, or insurance advice, and it is not an emergency service.

The human support layer

A key part of PorchswingProtect is that a real technician can watch your device’s check-ins and help you in person, remotely, or over the phone, depending on your plan. This human support is provided on a best-effort basis during our normal business hours. We monitor for problems but cannot promise we will see or respond to every event, or respond within any particular time, unless we’ve agreed that in writing. Higher plans include faster and broader support, as described at checkout.

Your account and activation codes

When you subscribe, you receive an activation code that turns on protection for your device(s). Keep your code and account details private — anyone with your code could use your subscription. Each plan allows a set number of devices:

  • Protect — 1 device.
  • Protect Plus — up to 3 devices.
  • Protect Premium — up to 5 devices.

Tell us promptly if you think your code or account has been compromised, and we’ll reissue it.

Subscriptions, billing, and automatic renewal

PorchswingProtect is a paid subscription, billed monthly or yearly through our payment processor, Stripe. Current prices are shown on our website at the time you buy.

Automatic renewal: your subscription automatically renews at the end of each billing period (each month for monthly plans, each year for yearly plans) and we will charge your payment method on file the then-current price, until you cancel. You can cancel at any time from your account in the app or by calling or emailing us (see “Contact” below). Cancellation stops future charges and takes effect at the end of your current billing period; when a subscription ends or is canceled, active protection pauses. We may send renewal or price-change reminders, and if a price changes we’ll give you notice before it applies to your next renewal.

30-day money-back guarantee: if you’re not satisfied, contact us within 30 days of your initial purchase and we’ll refund that payment in full. After the first 30 days, because protection is delivered continuously, payments already made are generally non-refundable except where required by law — but we want you treated fairly, so if something went wrong, contact us and we’ll work it out. Nothing here limits any refund or cancellation rights you have under California or other applicable law.

Acceptable use

Use the Services only for your own lawful, personal protection. Don’t share or resell your subscription, try to break or bypass the software’s security or device limits, interfere with our systems, or use the Services to do anything illegal.

Third-party software

PorchswingProtect includes open-source components, including the ClamAV antivirus engine, which are used under their own licenses. Those components are provided by their authors “as is.” The app also relies on services like our payment processor and email and hosting providers; your use of those is subject to their terms as well.

Privacy

Our Privacy Policy explains what information we collect (including device check-ins from the app) and how we use and protect it. By using the Services, you agree to that policy.

Our intellectual property

The PorchswingProtect app, our website, and our names, logos, and content are owned by Porchswing or our licensors. We grant you a limited, personal, non-transferable license to use the app while your subscription is active. You may not copy, modify, reverse-engineer, or redistribute it, except as the law allows.

Disclaimer of warranties

To the fullest extent allowed by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that they will detect or prevent all threats. Some states do not allow certain warranty exclusions, so some of these may not apply to you.

Limitation of liability

To the fullest extent allowed by law, Porchswing and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of money, identity theft, scam losses, or harm caused by a threat the Services did not detect or prevent. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the 12 months before the claim. Some states do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to cover Porchswing for claims, losses, and costs (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms or the law.

Suspending or ending the Services

You can stop using the Services and cancel any time. We may suspend or end the Services, or a particular account, if you violate these Terms, if we’re required to by law, or if we discontinue a product (we’ll give reasonable notice where we can). When your subscription ends, your license to use the app ends and protection pauses.

Changes to these Terms

We may update these Terms from time to time. We’ll change the “Last updated” date above and, for significant changes, give reasonable notice. Continuing to use the Services after a change means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. If we have a dispute, let’s try to resolve it informally first — contact us and give us a chance to make it right. Any dispute that isn’t resolved that way will be handled by the state or federal courts located in Placer County, California, and you and Porchswing agree to that venue, except where the law gives you the right to a different forum.
